Can Microsoft sue you for modding on Xbox Live?

My dad is an I.T officer, I've been trying to convince him to let me mod my Xbox 360 Elite. But he is worried about me getting banned and if Microsoft will plan to take action against my parents, or if they "have the ability" to do so. Can they sue my parents if I mod on xbox live?

Nope, they can not sue you from what I understand considering that you own the product. Though if you sell moded consoles (homebrew and illegals) that is where legal issues could come into play, but Microsoft really doesnt snoop the internet for that either.

The EULA says MS still own the xbox and you just bought a license to use the console so they could take it back from you if you mod it but I have never heard of them doing that, normally you just get banned from xbox live and that is the end of the story.

I know people say LT can not be detected but I myself do not believe it is true come September I am sure even LT drives will be getting banned.

lol. my dad and my mom are pissed. they said never to mention modding my game ever again, or else there will be consequences. Moderators, you can delete this thread if you want to.

Actually they can sue you for modding. your basically infringing on Intelectual Property rights by changing the software in the DVD drive.

However, given the amount of modded systems times attorney fees times the Probability that you will actually pay out it is just cheaper to ban your system and most likley buy a new one.

So your both right. You can get sued but microsoft would be stupid to do so. Guess they learned something from the RIAA.

That is the answer I was looking for all along, thank you so much, it fits my side of the argument too. Although idk what my dad will do to me if i say that to him.

I'm so fed up with this fight with my dad why doesn't he just let me to whatever the crap i want with my xbox.

Look at it from his point of view. If you download or upload pirated games and play them on your xbox on his internet connection in his house. He is ultimately responsible for your actions. And being in IT I know he is thinking that if he becomes the target of a lawsuit or piracy it could effect his carrer and his ability to provide the things you want.

I would just let it go and maybe focus your efforts on convincing him to perhaps get you a gamefly subscription.

I didn't want to flash my xbox so i could play pirated games. I wanted to flash it so I could play a modified version of GRAND THEFT AUTO, which I already have. And that's pretty much it. I'm not really interested in many other games to be honest.

So, you're telling me, that regardless of how many modders I see playing GTA online, I should just "let it go?" How can I let it go when there are so many other people doing it? I stopped playing the game altogether because of this. It's stupid really. Intellectual property rights? That is seriously one of the stupidest things I've ever heard of. I mean it's good if you want to stop piracy, but modifying a game? Big friggin deal. Why are they so concerned about what modifications you make to their game? It's not like you are going to build your own brand name company and start selling modified versions of games to make millions of dollars.

Sorry for my rant guys, it's just that I've been fighting with my dad over this for months, to find out that i cant do anything with my xbox. It's really kind of frustrating, when the WORST that can happen is my Xbox being banned from online. Why would Microsoft go through the trouble of suing somebody's parents just because they played a modified online game. Do you know how much time and money that'll cost them? Have you seen Microsoft suing anybody else over this?

He knows everyhing about computers. If he sees me hell take awwy my xbox. Hes really over protective.

Anyway, enough about my private life =/ this thread really shoudnt even be going.

haha cool. a friend of mine is giving me a DL DVD burner and some verbatim discs so I'm just going to burn the modded GTA onto the disk and hotswap, without my dad knowing. I'm not going to play online though, im using offline mods. He cant say anything then
