If you mean going online:

Some say no and some say yes. The most say Yes :D

As long as you have a CFW on your system. No matter if you start the CFW or if you are in the OFW, you are no longer safe.

Many people are online with the OFW (having cfw installed also) for ages and nothing happens.
Others have bad luck very quickly. So the risk is always there as soon as you have a cfw on your system.

But if you restore the CFW and remove everything else completely, everything should be safe again :)

If you only meant starting OFW without surfing the e-shop, making updates or online gaming or being online, there is no risk.

You're not risky for a SD card, but may be risky for others, using nsp or mod or something.

XCI or Nsp, before loading, they are just binaries, just like a photo file.

The only practical way to detect it's pirate software is to somehow calculate a hash code for it. But considering there're so many types of XCI (patched with DLC or updates or trimmed version). I won't bother to do so if I'm Nintendo.

By the way, owning a XCI is not crime, you are not going to be banned for owning it.
