bannings on xbox live are illigal?

I read through the XBL privacy policy and it doesn't allow for microsoft to look at the serial # on hard drives. It says they only can look at the xbox and dashboard version, nothing else. It doesn't say anything about bios or hard drive s/n. Wouldn't it be illigal for MS to get any other information off our xboxes other than what they specify in the privacy policy?

yeah but they probably have put somewhere very subtly that they can search other things if they want

either that or one day everyone will have to agree to another privacy policy which says they can search whatever

It does - it says it can look at the hardware - its right down at the bottom of the text.

It also says it has the right to refuse you service.

The service is also AS-IS.

Its just a normal all one way microsoft contract.

like someone already said, they have a clause that states that they have a right to deny service with no warning or explantion.

this is the only part that has anything about looking at the hardware.

Microsoft is able to identify which Xbox console and which version of the Xbox Dashboard you are currently using. This information is used specifically for the purpose of alerting Xbox Live to provide you with appropriate auto-updates to the Xbox Dashboard, and to protect the security of Xbox Live.
Where it says "identify which Xbox console" I would assume it means it can get the xbox's serial number. That wouldn't include the hard drive s/n, the hard drive serial number wouldn't be needed to "identify which Xbox console" you are using. Also, banning people who upgrade their hard drives would in no way "protect the security of Xbox Live."

Noob question - in the case of turning off the chip, why would that stop them from banning you based on HD S/N? They'll be able to get that S/N whether or not the chip is turned on or off, right?

Regardless of your setup you must switch off your chip before going onto live or you will get banned straight away (With the current 1959 bios anyway.... AHEM!)

When you first log on to live M$ marries your tag with the xbox set up, if you then change your HD, they will see that the HD seial number has changed and will boot yer off.

I think that's right anyway!! Please feel free to twat me if I am incorrect folks!

Hey, I think Shibz has a point here. In the ULA, it says it can detect your dashboard version and XBox serial number. They have no right to examine the crap you have on your box! Oh well, I guess I shouldn't get too riled, because I refuse to pay for that service anyway.

They arnt - simply looking at the hardware. If they write in the right to look at the contents, Im sure they will.

They are the lock masters and have all the keys.
