I dont think so. ur "circumventing" the encryption protecting the Game discs, so if u live in the US, the ______ ____ing DMCA applies to u. Atleast dats wat i hear / read elsewhere. Its perfectly OK to post on these forums (and X-S too) about making backups of games that u legally own.


If u live elsewhere, i envy u. Crap, I've never seen a crazier copyright law. Ok i CANNOT make ____ing backups of these games and protect my 50$/game investment? Its not like the discs ae indestructible.

Edit: btw the xbox drive is Thompson not Thomas.

Backups of original media are considered fair use under the DCMA.
Xbox games do not use DCSS encryption like DVD movies do - so nothing illegal there.
Basic guideline is that the backup is treated like a book - it can only be used in a single location at a time, by a single person (machine).

Now this all depends on:-

1) Where in the world you are.

2) What the terms of use are.

As a rule unless the documentation says you can make a back up; you should take it that you can't. (and an Xbox game does not)

Most if not all mod chips are sold with the understanding that you will only use it to play imports and 100% homebrew software E.G. Linux.

If you have flashed with any form of bios that enables you to play backup/import games then you have already broken the law (because all bioses that boot games either contain or have been written with MS copyright code), and thus what’s the point in this thread?

*technically* breaking the encryption on them does violate the DMCA...but the constitutionality of that point is very questionable.

Certainly they don't care so much if people backup their games...it's just that it makes it so easy to pirate games which worries them.

yea you can back up your games. Well im reading out of the back of a SW Clone Wars Manual and it says you may make 1 copy for backup purposes only........... hmmm interesting

Yeah, I thought that breaking ANY copy protection encryption is against the law. That's the way I understand it.

you cant back up ur games to ur xbox i dont think becuz dvd2xbox uses usigned micr$oft code so i think its illegal...

you can back-up your game without any "law" trouble, the problem itself resides in the way that you get your back-up, there is not a legally compiled program that lets you do the back-up, and there is not a legally BIOS that lets you boot unsinged programs or Games Back-ups....

In the US at least the irony is that it is not illegal to own backup copies of software, music, or movies for personal use (provided that you maintain ownership of the original media). The ironic twist is that the use of certain pieces of software to create the backup is illegal.

So, ownership of the backup - perfectly legal. The means to CREATE the backup, completely illegal. If you are doing this for personal use, then you will have nothing to fear ... if you are writing the software used to create the backups, then you might have something to worry about ... but if you are distributing the backups you are creating, then you will (and should) get slammed by the law.

You can't make copies it even says On the Xbox Game Disc itself and i quote "Do not make Illegal copies of this disc" there even on the disc it say's you cant, so you cant there im going back on SW Galaxies Now Bye!!! (im on Bria called Jwin BTW for any players of the game)

personally i dont care what the law says... if YOU bought the game, YOU have the right to make a backup copy of it on YOUR HDD ;)

cause your not giving anyone else a copy of the game... therefor the game companys aint losing ANY money from it... so there is NO harm done to ANYONE.

aint that a pretty strong argument? (i know there are laws and stuff about circumventing copy protection etc.. but u get my point)

This does not surplant your ability to make a backup as guaranteed under US federal law (unless you are not in the US). Backups for personal use are legal - they screwed us by making the software used to create the backup illegal.

Sort of like - smoking pot is not illegal, but the possession of pot is. Can't smoke it if you don't have it, even if it is not illegal to smoke, just possess.
