If its circumventing copy right that inplys that flashing for others is illegal but flashing for yourself isn't as your not circumventing it you are using it for personal use

Please don't flare if am wrong you can just say its just how I inturprate it

If I remember correct didn't mrmodchips get out of prosecution by saying piracy had already taken place before selling mod chips therefore it wasn't him circumventing piracy
That's why it is a grey area.

It doesnt matter if you do it for the Queen mother, it can be interpreted as Circumventing Copyright Protection, just like you interpreted it differently from the next guy.

i personally know someone who got in sh*t load of trouble for it in california they were selling games to and i dont know how the warrants read but it was all around xbox that got the feds knocking or should i say batter ramming in there door

If you flash a drive that doesn't make the console magically play pirated games - The games must then be copied - It just depends on how its looked at as to what point its illegal. It would depend on a judge/ your defense and would be taken to the supreme court. As far as I know no one has ever actually lost a suit for just flashing drives - most that I've read were eventually thrown out.

Selling copied games is a completly different story.

It really depends on the judge if u some how go to court. Some have just thrown the case out and some havnt. But selling games will have you caught and in court and is strongly not tolerated

not sure on the actual law in the uk but ebay wouldnt let me sell a faulty console flashed with LT+3.0. well, i was reported and listing removed.

they said it was a copyright violation as it had been moddified to play or encourage others to play copied/backup games.

if u look on fleabay and search 'xbox360 LT+3.0' there is only a couple of items now where there used to be loads. flashing services and consoles are mostly gone.

Karl is (or was) facing charges. I'm not sure how in depth he was going in his comment, though

If you were to write your OWN firmware from the ground up using no-one elses code for an xbox drive, to say, turn it into a pc dvd-rom. It's highly unlikely that that is illegal, there is no reverse engineering.

so your saying that because c4eva lt firmwares are reverse engineered from standard ms firmware, its copyright violation. even though i wont supply games in any form at all i can still be done!

so the same could be said about doing coolrunner installs, i know they ship blank but its us doing the programming of them when we fit them and re writing the nand with a modified file!

will be same for the demon in that circumstance

Does what you are doing circumvent copyright protection?

If so, you are breaking the law. The grey area is created because the end user then has to actually do it. However, that doesn't instantly make you legal.
 
i know buddy, but this is a service a lot of us offer on here, ive always known it to be a grey area, with never crossing the line of piracy i thought that would cover us.

if im asked where to get games from, i always reply to make a backup of your own games using a 0800 drive. as you never know who you are dealing with.

I will never be seen to promote piracy, would like to hear more on karls circumstances on this matter as it could help the rest of the comunity avoid these problems
