ok i popped in a backup of nba streets hom court and received a message on my screen saying i needed to update in order to play the game. i wanted to know is it safe to update? is there a chance updating it will knock out my flashed drive?

When the update is available you will get a popup on the 360 saying about the new update and it ask you whether if you want to download it or not.

Nope, not possible. If you want to play new games you will need to accept this update once it's on the discs.
