I have not played a single backup since the Spring Update.

I have only used original games since the spring update.

I have a Premium 360 with a Hitachi 78 drive flashed with Maximus 1.6.

The 360 was bought in November of 2007, played originals on Live for 2 months, then modded.

This prooves that the bans are not instantaneous as the Xbox has been offline since the 1st ban after the update on the 17th.

They have to have some way of being able to tell you have a modified firmware. At first I thought it was strictly a game issue, but now I'm leading more to the firmware side.

It's either one of two things:

A) MS can detect a backup disc and has records of this and is rolling out the bans slowly (honestly, they're catching more people this way, giving us hope)

or...

B) MS has someway of detecting modified hardware regardless of discs used, originals or backups, legit or downloaded, and is banning at their own discretion.

My advice:

If you've played a backup recently (past two months) or modified your FW, YOU WILL BE BANNED AT SOME POINT.

Get on Live and enjoy it while you can, YOU CAN BE BANNED WHILE YOURE OFFLINE 100% POSITIVE.

Just don't compound the problem by using backups or messing with your FW.

Anyone want to buy a banned 360 Premium?

Or more likely, the spring update checked to see if you had hacked firmware and took note of it. They start banning people later to get more people after they thought the update did not ban people.

My theory: If you flashed after the update (And don't play backups online) you should be fine.

anyway, i was banned while offline as well.

Deemon you can not know unless you go online and check but i wouldn't take that risk. As for now keep your consoles off until they come up with a solution to this.
