My switch got banned after firmware upgrade

Hi everyone,
I'm not sure how my switch got banned.
It happened after I updated from firmware 9.10 to 9.20 online in OFW mode.
All my games are in .xci and all had their latest updates through OFW mode.

My last update of my games through OFW mode is a few months back (pokemon sword and shield release) and didnt touch my switch for some time, battery was drained and i charged it last tuesday, and then i decided to update to the latest firmware when i saw it available on Saturday.

I'm always very careful to double check that I'm not in CFW before doing updates.
My switch wifi is always disable (no auto connection)

Thus, I'm not sure is it because the new firmware have other detection that cause the ban or something else.

And would like to know whether could I transfer my saved data from this ban switch to another switch (if i decided to buy 1).
I read online that Nintendo banned both console and account, and if you login with the banned account on the new switch, the new switch can be banned too.

I'm not sure whether my account is banned or not, as I can still login my account on nintendo webpage. I do not have switch online or cloud, so I can only transfer the save data by using the switch function.

If you have ever ran CFW you run the risk of a ban. Being on OFW makes no difference. Updating your games through OFW was probably where the flag came from.
