If by 'number 5 chip set' you mean Winbond, yes, as far as I know it's a mixed bag buying a 9504, you may get an MXIC or you may get a Winbond.

Yeah, I believe you could, there are OEM unlocked 9504 pcbs out there from systems that just never got updated to whatever dashboard started locking them.
