Safe to go live ?

Problem is since my xbox is dual nand my HDD1 is my internal drive that I use to play online , i should install the content of the first disk on my 32gb partition that is on my USB0 (1TB exHDD) but the game wont load it just stay on the loading screen and is choppy as hell. Ive install it on my internal HDD and it work great but since I go online with this drive is this safe to go online with the GTA V file on my drive or I need a workaround or something like that.

I just want to know if MS can ban me because Ill have the GTA V content install on my hdd that I go online with.

No currently the game isn't a legit one , its a jtag rip so thats why im confused
