SAMSUNG MS28 Sammy intermittent ejecting?

Ive just took in an xbox with a sammy ms28 drive in that will only eject with a disc in ?
Have read from another post that changing the black band will fix most non ejecting problems, but if it ejects with a disc could this be the solution to my problem ?
If so anyone know where i can get one from?
Have taken the drive apart and everything looks ok, nothing out of place or broken.

Change the band, you can find loads on ebay, i had a couple of old pioneer writers that i canabilsed them out of, tray doesn't zip open like it should but it does open without a disk in and thats the proof it works.

Put the band in a small bowl and pour boiling water over it , take out dry and put it back in the sammy , works everytime.
