should i get mine modded (questions)

i have my original xbox modded and love it. i was thinking about getting my 360 modded but i heard you can get banned from live.
questions
do you only get banned if you are playing the burned games when the ethernet cable is plugged in? can i just unplug it and play the burned games? if so, can i plug it back in and play games that i own? how can they ban you? can they tell from your saved games if it is an illegal copy?
i really want to mod it but i also want to play halo 3 on live. i dont want to get banned and not be able to play on live.
can somebody answer my questions

Then don't mod, it's as simple as that. It's a risk we all take and there's absolutely no way to guarantee that you won't get banned in the future so if Halo 3 on Live is that important to you then don't do it. If you do get banned you're banned for good, there's no getting back online unless you buy a new 360. You can still play everything offline though.
