Sorry to do this again but... Xbox Live Banning Question

I was involved in this huge discussion so I'll be short on this. My Xbox is working fine (has since Halo 2 came out) with my Xecuter 3 modchip. I am 100% sure my success has come from one of two (or both) facts:

1.) I did not use Xbox Live any before I modded my Xbox (no registration of my stock HDD)

2.) Before I got on Xbox Live I moved all modded material from my C: and E: to my F:. My C:/E: are all original.

My question is has ANYONE had success doing #2 but they HAD played Xbox Live before they modded their Xbox? I have a friend that wants his box modded but he's been playing on Halo2 Live on his stock Xbox. I'm afraid when I put a new HDD in there that even if I do #2, #1 will end up banning him. Thanks and once again I'm sorry to bring this crap up again.

I didn't play live before modding my box, and I've been fine since Halo2 came out. I haven't bothered moving files either.

If you've played live on that particular box, you risk being banned by upgrading the hdd.

Interesting. So you are playing on Xbox Live and have mod files in the C: and E: and it works fine!? Cool, let me know if this is the case, I wanted to use some of that 5 GIGS on E: for some APPS but was scared that they were scanning the C and E drives or something. Thanks

Using the ProSwitch, can't you leave your stock HD in place and switch back to it if you want to play the Xbox LIVE game?
Or is it only a tool that enables you to expand your capabilities of adding extra storage space? :?:

gi2ashoppa - Yea, so far so good. From the research I've done, having foreign files or unsigned code in the C: or E: isn't an issue. Then again, no one knows for sure what exactly causes a ban.

Ok, so what about getting a new eeprom? If my friend that has played Xbox Live on his unmodded Xbox wanted to mod his Xbox (with the X3) and he had a friend who he knew would never get on Xbox Live, using the X3 eeprom utilities would this be the only solution? Does anyone know of any instructions on retrieving and restoring eeprom codes? Thanks a lot.
