My first post!!! I have been reading these fourms for months now, but it is time I get involved. Here it is:

I have a hitachi 59 was running 2.3 fw did not update when spring update came out. I updated to 2.4 two days ago and was on XBL all day today with disc back-up.

The backup disc I used was Crackdown (my own copy, not scene release) and halo 3.

I would like to comment on something I have observed from scene released backups: I got as a scene relase game (too lazy to back it up myself) that will not work anymore now that I have updated to newest fw and d/l'ed spring MS update. I get the dirty disc error

I think that the issue is a game issue not a fw issue. For instance all games have a unique id and that is why any games that were scene released are showing up on multiple XBL accounts. MS will identify this unique id on multiple systems and ban it.

One last point and then I will shut up. You need to make sure that games have the proper ss, dmi and pfi. This ban could also result from improper use of those sealth files.

Best of luck to all Xbox is still a sick system and I am sad to hear all those wanting to leave for others :(

Well, what about rental games? Those would show up on mutliple XLive accounts, no? It would be unfair to the gamers and to the stores if that were the case. Although, with time, it is obvious that M$ will definitely try to move the console games into the category of uniqu ID games (like the PC) - I don't think it has happened yet.

well as for the first theory about 3 strikes and you're out cant be true for me, iv had my 360 since release date, played online for over a year before i modded in feb, so i would have 2 strikes but im banned :( i mite try getting on live again today just incase :p
i don't think the ban would just be limited to 3 strikes. I think if your system reads anything other than one to one (1:1) would warrant a ban.

Im bored of halo3 already and plan on buying a seperate core system for playing shadowrun online, so I reFlashed my drive today ms28 with xtreme52 lets see how long it takes me to get banned.
haha

you crazy man. but actually i'm the same way. after hearing about the bans, i got scared for a day, but then i said 'screw this'. curiousity got the best of me, and i wanted to know if i was banned.

yesterday i was playing halo 3 beta all night til 3pm CST, with scene backup of crackdown. i used to play co-op with a buddy on the same crackdown disc. i expect to get banned sooner or later, and if i do, i will do the same and pick up a core to play.

actually getting bored with halo 3 beta as well

Ya but I think he means two copys of the game ID on at the EXACT same time, which wouldnt happen with rentals.

I'm also curious:

Is there any pertinent information, before and after, that can be helpful to figuring out the bans?

Like I said before, I currently have an unbanned console, still playing scene backups online with all updates. I figure I will get banned sometime, so I am thinking I can take video of maybe the system info before, and when I do get banned, I can video afterwards.

Anything to help figure it out, I can live with a banned console; just pick up a new CORE that's all

isnt that the same thing they did with gamesaves? they downloaded all the game saves made a blacklist of them and any time you try to use those blacklisted game saves theyll come up as corrupt and etc. so they could of easily downloaded all the "wide spread" back up games took there id's made a black list in one of the updates and when you play one of them it automaticly bans your console. and to the people that dont have modded consoles could of played a rental version of a game that someone had used to make a back up that a couple people are playing at the same time or got "blacklisted". this theory and the firmware change theory have to be the top most likely things ive heard so far

another note is the banings dont seem to be worldwide just u.s. base. i guess they would be doing it through region just like how the live marketplace is only available certian places and why international players say there not banned and only u.s. users report they have been. i have not read one report about someone being banned internationally yet it seems always u.s. based

One problem with that whole thoery.

One problem with that whole theory.
Every game I have a copy of I still own.
Every game I have a copy of is still owned by me.
I have 42 games everyone has a backup.

I have never played a backup online, and I got banned.
Using my real copy of crackdown, not my backup.

Like I said in my previous posts. I have two 360's so
its not a big deal to me because they didnt ban the
live account, so I can just switch my hard drive.

Anyways I think everyone is getting to techinal with the reasons.
I mean people need to look at this from different angles and not
the hardest possible ones first.

I was talking to a friend and even though its not true it very well
could be as simple as this.
Opening your system ungrounds something and they can tell.
I mean hell I know its not true but there could be something like that.

I have talked to a few of the people who said they got banned, but
havent modded.
Of the four people I talked to all of them said they have opened there
systems.

Just another thought even if the open case theory is completely wrong
just thought everyone should take a step back and wonder if there
is an easier way to detect if someone modded there system.

^^ Mine hasn't been modded but I was about to. Mines gone in for repair so obviously it has been opened and I'm not banned.

I'm in Australia and they're banning here too.

I have one friend who has flashed only once before going on LIVE and he uses a combination of SCENE disks and his own. He has a NOT been banned.

He has another friend who was on LIVE for at least a year before he modded it and he too has not been banned. Weird.

I have a whole bunch of other friends who have been banned.

It really seems to be all over the shop and I believe it is going to take awhile before we find out how this is beiing done.

I just got banned today... :(

The last time I was on was before the mass banning and today after spending hours on the forums I decided to turn it on and sure enough I couldn't connect to XBL.

So what this means is that the ban isn't instantaneous, and while I'm not sure exactly how they do it they obviously detect modded consoles log the serial numbers and at a later time ban any logged consoles. Meaning that you could get banned even if you haven't been on in months.

Its funny cuz one of my friends freaked out when he heard the news and begged me to un-mod his 360 today to hopefully avoid getting banned. I'll bet anything that his box has already been logged and in a few days he's gonna be pretty pissed when he can no longer log on.

To be honest, I fully understand M$ position on this topic and don't blame them for what they are doing. The part that pisses me off is that they mislead people, by not banning modded consoles from the start, into believing that it was safe to mod or atleast that there was little risk. And to just suddenly out of the blue do this on a mass scale is pretty cheap and underhanded.

Id just rather pay 3 dollars for a verbatim dual layer dvd-r rather than 60 dollars for another copy of crackdown, when my system decides to ring it.

I haven't been banned yet, even tho mine is still modded;however, I didnt mod mine untill AFTER the spring update, maybe while you were updating it logged everybody with a modded 360 and now they are giving them out. anyways. I know its not "legal" to make backups of your 360 games, but I think its dumb especially when I have receipts for all the games. anyways I still havent been banned, I just think they could of handled it diffrently.

What we need is a firmware that scrambles and randomises the unique serial number so that everytime you turn it on you have a different I.D and therefore you will almost be guaranteed to get on live unless it randomises the number to another banned consoles unique I.D, what does everyone think?

also then all banned boxes will be able to get BACK on xbox live so there will be no need to buy a new one!
