Will i be banned from XBL if i use a firmware flash?

basically i just want too know if i flash my dvd drive with some firm ware will i be banned from XBL?
the only reason i want too do this is because my 360 destroyed my copy of gears of war i bought and i want too copy my freinds so i dont have too buy a new one. and i want too mod Halo 2 (im a huge Halo pc modder)

i just falshed my drive about 3 weeks ago and i have not gotten banned. Someppl have had theres flashed for over 6 months and have not gotten banned. AS far as halo 2. Modding in that will get u banned from matchmaking. But u will be fine as far as xbox live in it entirety.

You cannot mod games with the 360. This is what lead, for the most part, to banning with the original xbox.

Xbox 360 backups must be true backups. We cannot sign our own files, so you can't change anything.

um i mod halo 2 with my 360. And yes the files on the disc. As far as i know you only get banned from halo 2 matchmaking for that.

If you would have done a search around or read the tutorial you would know the answer to this question already. The firmware hacks have been around for around 10 months now. People have been using them this entire time on Xbox Live. Even using backups on Live. Not a single person has been banned from Live for the firmware hacks. Using a modified system on Xbox Live violates the Xbox Live Terms of Service that you agreed to when you signed up for Live. They reserve the right to permanently ban your system and/or account at any time without refund, and for any reason or no reason at all.

Currently you can use a firmware-flashed system on Xbox Live without being banned. You can download dashboard and game updates just fine. This may all change in the future, depending on what Microsoft may or may not do. Use the firmware on Xbox Live at your own risk.
