i've said it many a time before, I got 2 eeproms, instead of buying one and a hd, tried to install one, and after 3 months w/o replacing the HD... im still unbanned, I dont think the marriage theory is wrong, I just dont think it applies to everyone who gets banned.

Honestly, I'd just pay for the new Xbox but that's just me
I'm with you Falco, I would also buy a new box just for Live, If I"m going to pay a monthly fee to play online I would want to have that protection, of not getting banned.

$90 BANNING FEE!

That's right people, it's been confirmed! People who are getting banned are being charged a $90 re-activation fee. You've heard it here first.

The info in the new eeprom is all unbanned info. I thought by replacing the banned eeprom with an unbanned eeprom Live would work again....I thought this is how it worked.

Someone correct me if I am wrong...

Yea, you should be alright. Just don't attempt to log onto xbox live with the prebanned live account. To what I've read, they flag your account and ban the console that you log into.
